PowerTread Terms of Service

Welcome to PowerTread! These Terms of Service ("Terms") govern your use of the PowerTread mobile application (the "App"), provided by NoVa Solutions Group, LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. No Account Required & Data Handling

The PowerTread App is designed for immediate use without the need for user accounts. We do not require you to create an account to use the core functionalities of the App.

Your workout data, GPX course files, and any other personal fitness data generated or loaded within the App remain exclusively on your device. We do not collect, transmit, store, or have access to your personal data or workout activities on our servers. Your privacy is paramount, and your data stays with you.

2. Third-Party Integrations

The App may offer optional features to connect with and sync your activity data to third-party fitness platforms, such as Strava. These integrations are entirely opt-in and require your explicit authorization.

You are in full control of authorizing and deactivating these connections at any time within the App's settings.
When you authorize a connection, data will be shared directly between your device and the selected third-party service, subject to their respective terms of service and privacy policies. We are not responsible for the data practices of these third-party services.

3. Use of the App & Health Disclaimer

The PowerTread App is a tool designed to enhance your treadmill training experience. You acknowledge and agree that:

Use of the App is at Your Own Risk: Exercise, especially intense physical activity like running, carries inherent risks. You are solely responsible for your physical condition and for exercising safely.
Consult Your Doctor: Before beginning any exercise program, including using the PowerTread App with your treadmill, you should consult with your physician or other qualified healthcare professional. The App is not a substitute for professional medical advice, diagnosis, or treatment.
Device Compatibility: You are responsible for ensuring that your treadmill and any connected sensors (e.g., Stryd Power Meter) are compatible with the App and are in proper working order.
Safety Precautions: Always follow the safety guidelines provided by your treadmill manufacturer and exercise caution while running.

4. Intellectual Property

All content, features, and functionality of the App, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by NoVa Solutions Group, LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The PowerTread name, the PowerTread logo, and all related names, logos, product and service names, designs, and slogans are trademarks of NoVa Solutions Group, LLC or its affiliates or licensors. You must not use such marks without the prior written permission of NoVa Solutions Group, LLC.

5. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, NOVA SOLUTIONS GROUP, LLC HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE.

6. Limitation of Liability

IN NO EVENT WILL NOVA SOLUTIONS GROUP, LLC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE APP OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

7. Changes to These Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the App thereafter. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.

8. Governing Law and Jurisdiction

All matters relating to the App and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the Commonwealth of Virginia, without giving effect to any choice or conflict of law provision or rule.
